There has never been a better or more affordable time to have a Lasting Power of Attorney put in place- Here's why:
At Crosby & Woods Solicitors we often see firsthand the huge day to day difficulties faced by both our clients, but more usually by their loved ones, when sudden or slow onset of illness strikes rendering a person unable to manage their own affairs in an orderly manner and in the way they would manage them themselves if they still well enough to do so.
Whilst statistically the inability to manage one's affairs does affect our more elderly clients, incapacity can strike at any age so some sensible forward planning in case of that eventuality is something as a firm we encourage all clients to consider so they can rest easy knowing appropriate arrangements are in place already.
A lasting power of attorney (LPA) is a legal document that lets you (the ‘donor’) appoint one or more people (known as ‘attorneys’) to help you make decisions or to make decisions on your behalf. This gives you more control over what happens to you if you have an accident or an illness and can’t make your own decisions (you ‘lack mental capacity’).
It also allows you to specifically select who you wish to manage your affairs when you cannot, whether that be a partner, a close family member or friend or when none of these people are either suitable or available, a Solicitor with proven experience of professionally managing the day to day affairs of clients can undertake the role.
You must be 18 or over and have mental capacity (the ability to make your own decisions) when you make your LPA.
There are 2 types of LPA: ·
· Health and Welfare
· Property and Financial Affairs
